Is your app available in the App Store in the EU? Then you hopefully already know about this change, but in case you don't:
To comply with the EU's Digital Services Act (DSA), Apple is asking that all developers declare their trader status in App Store Connect by February 17, 2025.
Failure to do so might lead to your app being removed from the EU App Store.
In this blog post, we'll break down what the DSA means for app developers on the App Store and some of the actions required by Apple to help you stay compliant.
What is trader status and why does it matter?
Under the DSA, a "trader" is formally defined as "any natural person, or any legal person irrespective of whether privately or publicly owned, who is acting, including through any person acting in his or her name or on his or her behalf, for purposes relating to his or her trade, business, craft or profession."
If this doesn't clear things up, Apple itself suggests the following key indicators that you might be classified as a trader:
- Your app generates revenue through in-app purchases, ads, or subscriptions.
- You promote or advertise your services through your app.
- You are VAT-registered in the EU.
- Your app is linked to a business or profession.
Please note that even if you're not a trader, you must still declare your status.
What does Apple require from developers?
To comply with the DSA, developers must submit the following information via App Store Connect:
- For organizations:
- The address associated with your D-U-N-S Number (pre-filled by Apple).
- A phone number and email address.
- For individuals:
- A valid address or P.O. Box.
- A phone number and email address.
Additionally, developers must ensure that their payment account details are up to date. Full details regarding this change and how to stay compliant in the App Store are available here.
When is the deadline for declaring my DSA trader status for Apple?
Failure to declare or verify your trader status by the deadline – February 17, 2025 – could result in your app being removed from the EU App Store until you comply. If you are interested in learning more about the DSA, the European Commission has published information available here.
If you're unsure about your classification, we recommend consulting a legal expert.
