Bitrise for Jira (the "App") is provided free of charge by Bitrise. By installing or using the App you agree to these Terms of Use (“Terms”). If you do not agree to be bound by these Terms, do not install the App.

1. Bitrise Services. The App provides an interface for accessing certain features of the Bitrise Services through Jira. “Bitrise” and “Bitrise Services” shall have the meaning assigned to them in the Bitrise Terms of Service available at: Terms of Service (the “TOS”). Any use of the Bitrise Services remains subject to the TOS or any other document as specifically referenced therein. Nothing in these Terms is intended to amend and/or otherwise supplement your rights and obligations in connection with the Bitrise Services.

2. Licence. Bitrise grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App with your Jira Cloud to install and use the App with your Jira Cloud site, meaning Atlassian's "Cloud Products" as defined in the Atlassian Customer Agreement.

3. Restrictions. You may not sell, sublicense, rent or otherwise redistribute the App; modify, decompile or reverse engineer it, except to the extent applicable law expressly permits and cannot be waived; remove or obscure any proprietary notices; or use it to develop a competing product.

4. Ownership. The App is licensed, not sold. Bitrise and its licensors retain all right, title and interest in the App, including all intellectual property rights. No rights are granted other than those expressly stated.

5. No warranty. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, UNINTERRUPTED OR ERROR-FREE OPERATION, OR NON-INFRINGEMENT. YOU USE THE APP AT YOUR OWN RISK.

6. No liability. To the maximum extent permitted by law, Bitrise will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost revenue, lost data or business interruption, arising out of or relating to the App, regardless of the theory of liability. Bitrise's total aggregate liability relating to the App will not exceed USD 100. Nothing in these Terms excludes liability that cannot lawfully be excluded.

7. No support or availability commitment. The App is offered without any service level, uptime, support, or update commitment. Bitrise may change, suspend or discontinue the App, in whole or in part, at any time and without notice. Any support Bitrise chooses to provide is discretionary.

8. Term and termination. These Terms apply for as long as the App is installed. You may terminate at any time by uninstalling it. In addition to Bitrise’s rights under Section 7 of these Terms, Bitrise may terminate the licence granted herein if you breach these Terms. Sections 3 through 6 survive termination.

9. Relationship to Atlassian. Atlassian is not a party to these Terms and has no obligation or liability in respect of the App. Your use of Jira and the Atlassian Marketplace remains governed by your agreements with Atlassian. Nothing in these Terms limits your rights or obligations under those agreements.

10. Governing law. These terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules.

11. Changes. Bitrise may update these Terms from time to time. The current version is always available at the link in the App's Marketplace listing. Continued use of the App after an update constitutes acceptance.
